Can Court Marriage Be Cancelled?

Court marriage in Pakistan is a process of getting married in a non-traditional way. A Pakistani traditional marriage is three days long (sometimes more than three days, depending upon the choice) process. First, the Nikah ceremony, then mehendi, and then Barat festivities and Walima, a Pakistani marriage is incomplete without these functions. However, a court marriage does not involve any of these festivities. However, some people must wonder whether a court can be cancelled or not. The answer to the question is simple, and it is “no, the court marriage cannot be cancelled”. Why Can’t a Court Marriage Be Cancelled?

It is a Legal Process:

One of the main reasons that court marriages can not be cancelled or nullified is the fact that they are legal in Pakistan. Pakistan’s Marriage Act allows any couple who has reached the legal age of marriage( 16 years for girls, 18 years for boys) to get married in court. Any adult person can marry through the court marriage process without the permission of their guardian.

The bond of Nikah binds it.

Another reason why a court marriage cannot be cancelled is the fact that its foundation is based on Nikah. Court marriage does not mean that the couple only signs papers in court but it also means that the couple has attended their Nikah ceremony and has said the vows in the presence of witnesses and the nikah registrar. Therefore, a Nikah can not be cancelled unless it’s forced or the couple themselves agree to get a divorce.

It’s a registered marriage:

Like all other marriages, court marriage also has to be registered with the authorities. As soon as the nikah happens, the couple has to register their Nikah in court and get a marriage certificate.

Registered marriages are legit marriages, therefore, they cannot be cancelled by the court or anyone.

It’s a consensual marriage:

Marriages that are forced or are done as a result of abduction or kidnapping can easily be cancelled by the court as these marriages do not have the consent of either one of the partners. Court marriage that is consensual and has occurred with the couple’s consent cannot be cancelled.
