Can I Get Married Without My Parent’s Approval?

Marriages in Pakistan are usually based on Islamic teachings and laws of the country. If we see marriage from an Islamic point of view, then Islam encourages the couple to seek their guardian or wali’s permission before marriage. For girls, it is prohibited to get married without the guardian’s or father’s (wali’s) permission in accordance with Islam. However, if the Wali or father wrongfully denies the girl’s choice, then she can get married to anyone she likes.

As per Pakistani legal rules, a boy and a girl can get married without the approval or permission of their parents. If you are wondering how this process would go, read the article till the end.

How to get married without parent’s approval in Pakistan:

Gather the documents:

The first and foremost step before going for a marriage without your parents’ permission is to gather all the necessary documentation. If you do not have your identification documents, you might not be eligible to get married. So get your hands on your Cnic, birth certificate and also get two or three passport-sized photos.

Get a court marriage lawyer:

Getting married without parents can take a toll on your physical, financial, and emotional health, so it’s better to contact any trustable court marriage lawyer. Having a lawyer is crucial for court hearings where the couple will need support and guidance.

Get married in court:

The only way you can have the partner of your choice without your family’s or parents’ approval is to get married through the court. For this, you will have to get nikah done and then submit your Nikah Nama in court. The court will recognize your marriage, and you can live as husband and wife without your parents’ permission.

Submit the affidavit of free will:

Submitting an affidavit of free will in cases where the parents are not in favor of the marriage is a wise move. You can get the affidavit from the court and then submit it after filling out the contents. This affidavit of free will is proof that the couple got married not under the influence of anyone but just because they wanted to do so. This document will serve as proof of consensual marriage in court and for the families as well in case they try to frame the couple for forceful marriage.
